Whilst we endeavour to ensure that all information displayed on our website is accurate and up-to-date, the information is provided 'as is' and E S Web Design cannot therefore be held responsible for any actions made based upon the said information.

Content of the E S Web Design website is protected by copyright and intellectual property laws and may not be redistributed, repackaged or used in any way whatsoever unless written permission has been first granted.

E S Web Design does not accept any liability [including negligence] in respect of third party information or other material made available on, or which can be accessed using, this website.

E S Web Design provide the website features as described in the quotations received. All quotations are valid for 30 days, unless otherwise stated or third party services, of which we have no control, are altered.

The following payment terms shall apply upon confirmation by the client unless specifically varied in writing by E S Web Design:

E S Web Design will require a 50% deposit to be paid prior to commencement of work on account of fees likely to be incurred. An invoice for the remaining 50% of the fees will be presented to the client on completion of the services provided and will be due for payment strictly within 30 days of submission. All fees quoted are exclusive of VAT which, if applicable, in respect of any goods, work or services supplied by E S Web Design will be implemented at the current rate and added to payments otherwise due.

Additional features to websites including, but not limited to, extra database services, specific hosting requirements and animations that are not included in the quotation are subject to a surcharge. In the event a feature is required which has not been included in the quotation, E S Web Design will give notice prior to implementation and seek acceptance of the surcharge. The cost will be added to the final invoice unless the amount exceeds £500 + VAT. In this case, an interim 50% invoice shall be issued with payment due before completion, with the remaining 50% added to the final invoice.

In the event that full payment is made later than required or if only partial payment is made, E S Web Design may at its discretion charge for administration costs and interest on any monies owed at the rate of 2.5% interest per month, calculated weekly and compounded monthly. Failure to apply such charges does not constitute a waiver of the option to charge.

E S Web Design reserves the right to withdraw its services at its entire discretion. Upon such withdrawal of its services, E S Web Design shall be under no liability whatsoever to the client for any costs, losses and damages, howsoever arising, that the client may incur or may have incurred.

It is hereby agreed between E S Web Design and the client that in the event that any monies are owed and overdue, E S Web Design will withdraw its services and may remove any material stored upon any computer or server and shall retain such material. E S Web Design shall not be liable for any loss, monetary or otherwise, and not be under any obligation to return or provide access to, any and all documents, papers, etc. belonging to the client until payment is made in full.

Copyright in all documents, papers, etc. prepared or caused to be prepared by E S Web Design is expressly reserved by E S Web Design unless otherwise stated.

E S Web Design will not be held responsible for the failure of any of the services provided by a third party to E S Web Design for the client, this may include, but is not restricted to, internet promotions and third party multimedia provisions.

All completed websites become the property of the client, subject to all accounts being paid, with the following restrictions on use:

1.] Only one instance of a website can be made available on the World Wide Web or any Intranets / Extranets unless a licensing agreement has been reached

2.] Database connection strings will not be divulged to the client due to security risks [These strings would in any event need amending if the site was to be moved to an alternative host / server].

3.] No portion of the coding can be copied / duplicated or redistributed in any form, electronic or otherwise, unless a licensing agreement has been reached. Please note that upon request website files can be provided via email, or on CD at a cost of £10 + VAT.

In the rare event of a problem with your website E S Web Design will endeavour to solve the discrepancy as quickly as possible. Please email enquiries@eswebdesign.com and describe any problems that you may be experiencing. E S Web Design cannot accept responsibility for any loss, either monetary or otherwise, due to website failure or misuse.

All data and information stored in an online database remains the property of the client along with any rights associated with it.

Once work has commenced, which will only be undertaken once E S Web Design has received the client's initial 50% payment, no refunds will be given.

You can allow us to enter your text and images by sending us the content in electronic form and we will implement this into your website for you. Please note if we have not received your content in electronic form within 2 months of meeting, at this stage we are entitled to sign you off and will presume you want to implement the content yourself.

All E S Web Design websites are built for optimal viewing resolution and to be compatible with Internet Explorer 6 and above. Websites are also compatible with FireFox, Chrome and Safari, however advanced features may not be supported in some older browsers.

E S Web Design reserves the right to update or alter these terms and conditions at any time without prior notice.
